The Contracts Manager/Contract Specialist is responsible for the contractual aspects of the Fargo-Moorhead Metropolitan Area Flood Risk Management Project - Diversion Channel and Associated Infrastructure Works. The incumbent will report to the Commercial Manager and be responsible for the management of contract administration, subcontracts administration, changes and claims.

  • Assist the Procurement Department in the preparation, negotiation and finalization of all subcontracts, purchase contracts, purchase orders with Subcontractors, Service Providers and Suppliers.
  • Assist the project team throughout the project lifecycle to ensure compliance with D&B Contract obligations is maintained.
  • Assist the project team with the preparation of notices and correspondence including capturing subcontractor / service providers / supplier delays and notifications in accordance with the D&C Contract requirements, Subcontract requirements and contract management best practices.
  • Prepare correspondence and Delay and Supervening Event Notices including updating of ongoing delays / events in accordance with the D&C Contract to ensure entitlements are maintained.
  • Assist in the modification of contractual management policies, procedures and systems to remain compliant with the D&C Contract obligations.
  • Assist in the preparation of monthly internal and external reports on contract/commercial matters, as required.
  • Manage D&C Contract / subcontract administration, changes and claims.
  • Assist in the preparation of D&C Contract claims including defining contractual entitlement and ensuring the required level of substantiation and quantification is provided to achieve the objective of the claim.
  • Support the defense of claims arising from Subcontractors, Service Providers and Suppliers including refuting contractual entitlement (if applicable) or fairly evaluating the claims ensuring that the required level of substantiation and quantification is provided to support their claims.
  • Manage the financial / commercial considerations around change orders and claims with the Developer and Supply Chain.
  • Assist the project team with the requirements for contract close-out to achieve formal project acceptance.
  • Maintain a good understanding of the contractual issues on the Project.
  • Prepare, maintain and provide access to all the Project's contractual documentation.
  • Ensure Subcontractors, Service Providers and Suppliers have access to the correct design specifications and drawings and conduct reviews of work to ensure compliance to the correct contractual documentation, specifications and drawings.
Requirements
  • Degree in Engineering / Quantity Surveying / Business / Law / Contract Management (or equivalent).
  • Minimum 10 years of contract/commercial management experience on large construction projects ($100M+), including stewardship of all contract terms and conditions.
  • Experience in managing major subcontracts and design consultancy agreements.
  • Advanced knowledge of construction contract administration and the principles of purchasing, finance and estimating.
  • Proven contractual management ability.
  • Good interpersonal skills.

  • Thorough knowledge of contract language and legal requirements of contracts.

  • Ability to operate under pressure and to meet tight and demanding deadlines.
  • Experience working within a P3 and/or Design-Build Environment would be preferred but not required.
  • Experience working for a Contractor would be preferred but not required.
  • Experience in claim/dispute management would be preferred but not required.

* This position is an office position which will include work at a desk and use of email, Microsoft Office, and various other software as required.
